2 More Days Of Jail For Das And Ranka, CJP Cries 'Undeclared Emergency'

The Fact: Cockroach Janata Party (CJP) leaders Saurav Das and Ashutosh Ranka will remain in Tihar jail for 2 more days. The two were produced before the Special Executive Magistrate (SEM) court at Mandir Marg police station on Monday after five days in judicial custody. The Delhi Police had sought 5 more days’ custody, alleging they could disrupt public order if released. CJP has accused authorities of deliberately delaying their release, questioning the rejection of sureties and repeated postponements of the hearing.
The Context: Das and Ranka were arrested on October 14 after allegedly entering the denotified Jantar Mantar protest site by climbing over a locked gate and unfurling the national flag. Police registered cases involving alleged trespass, disobedience of public orders, obstruction of officials and breach of peace bonds. The CJP, however, has centred its campaign on the right to unfurl the Tricolour and protest against Chief Election Commissioner Gyanesh Kumar. CJP legal head Ratna Singh alleged that the hearing, initially scheduled for noon, was pushed into the evening and that four sureties were rejected. Police, meanwhile, said the magistrate had received threats demanding the duo’s release. Legal questions have also emerged in the case - The Indian Express noted that criminal trespass requires proof of specific intent to commit an offence or intimidate, insult or annoy someone in possession of the property. Unauthorised entry alone may not automatically establish the offence.
The Peek Insight: The arrests have marked a shift in the protest, from demanding the CEC’s resignation to challenging the legality of detentions and the restrictions on dissent. The government has largely contained this phase of the campaign, preventing it from gaining the same visible momentum as the earlier protests. But a quieter protest does not necessarily mean the underlying concerns have disappeared. The larger test is whether authorities can enforce restrictions lawfully while not undermining the democratic right to peaceful protest. The arrests of CJP Leaders Abhijeet Dipke, Saurav Das, and Ashutosh Ranka have practically made the CJP movement leaderless. While Dipke is out of jail now, Das and Ranka's extended incarceration despite no calls for fresh protests raises questions about whether the aim is to weaken a pressure group structurally.
